Terms of Business

Please read these Terms of Business carefully. TOTM reserves the right to change or revise these terms at any time, circulating the revisions. TOTM encourages you to review the terms whenever you place an order to understand the ongoing use of its services.

Supply of goods – TOTM will supply all goods in good order. We will not be held liable for the condition or contents of goods arriving at users chosen delivery address after 5 working days of delivery. We therefore encourage customers to check stock and notify TOTM of any issues or concerns within this timeframe.

TOTM supplies all boxes of tampons with an instruction leaflet, adhering to best practice as recommended by the AHPMA (‘Absorbent Hygiene Product Manufacturers Association’).  This leaflet provides clear advice and guidance on the use of tampons.  It includes information on tampons suited to different flows; how to use a TOTM tampon; when to change a tampon and information about Toxic Shock Syndrome (TSS).   The TOTM workplace boxes in which the tampons are sold also contain a link to the leaflet provided (on the box).  Customers should ensure that there is access to the leaflet itself or the link via the tampon workplace box to all employees or colleagues.  We recommend keeping TOTM product in the boxes provided for this very purpose.

Force Majeure – If TOTM is unable to perform its obligations due to reasons beyond our control, such as strikes, civil disorder, regulations or orders of governmental authorities or natural disaster, non-performance is excused. TOTM may negotiate a new delivery date. If parties cannot agree on a new date that is acceptable, TOTM will return the portion of the funds paid prior to the force majeure event not used in attempting delivery.

Payment Terms – Payment is required within 30 days of invoice (NET 30), unless otherwise agreed in writing with your TOTM account manager. TOTM has the right to withhold future orders where invoices are unpaid. TOTM may also exercise the right to charge interest or fees on unpaid invoices where necessary.

Brand representation – TOTM is a registered trademark. Where there is infringement or misrepresentation of the brand or where the brand assets are used without our permission you will be notified, and we reserve the right to withhold any pending orders until the issue is rectified. This includes any product details or images which are incorrect, untruthful or contradict TOTM’s brand guidelines. TOTM reserves the right to cease trading if it is deemed that the brand is misrepresented resulting in a negative impact on brand image. We respectfully request that the following conditions are met on all product listings online and marketing materials.

• All logos and images are of high quality and resolution and used as provided and advised by TOTM with our prior permission.
• Product descriptions and images are as specified and are updated when requested.
• Any relevant warnings or regulatory information must be displayed.
• Product listings must reference any certifications with accuracy.
• TOTM does not permit the use of its brand name within any website domain without prior agreement.

Delivery – TOTM will acknowledge an order within 2 working days, in which a proposed delivery date will be confirmed. TOTM gives estimated lead times when starting relationships with new customers, however these are non-binding and subject to change dependent on demand and order size. In the case of attempted and failed delivery, where the customer was not able to receive on the notified or arranged date/time, TOTM may exercise the right to charge fees for re-delivery.

Re-sale – TOTM products under this business arrangement are not for re-sale unless this has been specifically agreed in accordance with a written agreement with TOTM. If a customer is found to be re-selling product without permission, TOTM will terminate business immediately.
